Terms of Service

Effective from:

These Terms set out the rules for using ECU.EXPERT (https://ecu.expert), including creating an account, buying credits and ordering ECU file modifications. Before concluding a contract you can read, download and print these Terms (for example with your browser's print function).

1.Service provider and contact

ECU.EXPERT, available at ecu.expert, is run by its operator (the "Provider").

Contact, including about requests, payments and complaints: ecuexpert2026@gmail.com. Personal data matters are covered by the Privacy Policy.

2.Definitions

  • Customer: a natural person, legal person or organisational unit that has created an account on the website.
  • Consumer: a Customer who is a natural person concluding a contract not directly related to their business or profession.
  • Sole trader with consumer rights: a natural person running a sole proprietorship who concludes a contract directly related to that business but not of a professional nature for them (Art. 385⁵ of the Polish Civil Code and Art. 38a of the Polish Consumer Rights Act). The provisions on Consumers apply to them to the extent provided by law.
  • ORI file: the original, unmodified ECU software file read by the Customer and uploaded to the website.
  • MOD file: a file prepared by the Provider from the ORI file, in successive versions (V1, V2, …).
  • Request: an order for one or more modification services for a Customer's project (vehicle).
  • Specialist: a person acting for the Provider who prepares and checks MOD files.
  • Credits: the website's internal units of account described in the "Credits" section.

3.Services

The Provider supplies the following services electronically:

  1. running the Customer's account (free of charge), including storing projects, files and request history;
  2. modifications of ORI files ordered as Requests and paid for in Credits according to the price list, such as Stage 1, EGR OFF and AdBlue OFF; the current list of services and prices is on the Pricing page and in the Request form;
  3. selling Credit packages.

How it works: the Customer creates a project with the vehicle details and uploads the ORI file (in one of the formats listed in the upload form, e.g. .bin, up to 32 MB), chooses the services and submits a Request. A Specialist reviews the Request, prepares the MOD file by hand and publishes it in the Customer's dashboard, where the Customer can download it. Each MOD version lists the modifications made. The Provider doesn't write files to vehicles: reading and writing the ECU is done by the Customer or a workshop of their choice.

Technical requirements: a device with Internet access, an up-to-date browser with JavaScript and the cookies needed for sign-in enabled, and an active email address.

We carry out Requests without undue delay, in the order they are accepted. We tell the Customer about every change of a Request's status in the dashboard and by email.

4.Account

The account contract is concluded when the account is created (with an email address and password or a Google account) and runs for an indefinite period.

  • The Customer provides true information and keeps it up to date.
  • The Customer protects their sign-in details, doesn't share the account with unauthorised persons and promptly informs the Provider of any suspected unauthorised access. A business account may be used by persons the Customer authorises; the Customer is responsible for their actions.
  • It is prohibited to: upload files the Customer has no right to, files containing malware or unlawful content; circumvent the website's security; scrape data from the website; resell access to the account; use the website in breach of the law or the rights of others.

The Customer may terminate the account contract at any time by requesting account deletion at ecuexpert2026@gmail.com. The Provider may terminate the account contract for important reasons, in particular a breach of these Terms or of the law, by informing the Customer by email and stating the reason.

Ending the account contract doesn't affect Requests in progress, which are completed or settled under these Terms, or the settlement of unused Credits (see "Returning credits vs refunding money").

5.Credits

  • Credits are a prepaid balance used only to pay for services on the website. They are not money, electronic money, cryptocurrency, a financial instrument or an investment. They can't be transferred to another account, sold or exchanged for cash, except for the refunds described in these Terms.
  • Credits don't expire.
  • The balance consists of available credits and credits reserved for Requests in progress. Every balance change (purchase, reservation, settlement, return, adjustment) is recorded in the history shown in the Customer's dashboard.
  • Service prices in Credits are set by the Provider in the price list. The price list may set a bundle price (such as Stage 1 + EGR OFF) lower than the sum of the prices. Services already delivered in the same project aren't charged again.
  • Price list changes don't affect submitted Requests: each Request keeps the price at the time it was submitted. If the price changes between displaying the form and submitting it, the website asks you to confirm the new price.
  • The Provider may grant Credits free of charge (for example as a promotion or compensation) or correct the balance after an error. Every adjustment is recorded in the history with its date, and its reason in the Provider's records.

6.Buying credits and payments

Credit packages are available in the Customer's dashboard. Before buying, you see the number of Credits and the gross package price (including taxes) in the package currency (PLN or EUR). The payment page may also show the amount converted to your local currency.

Payment takes place on Stripe Checkout. The available methods (such as card, Apple Pay, Google Pay, Link, BLIK, Przelewy24) depend on the payment configuration and the payer's country. The Provider never receives card details or bank sign-in details.

When a payment is handled through Stripe Managed Payments, Stripe is the seller (merchant of record) of the package to the Customer, and the purchase is shown as "Sold through Link". Stripe then sends the payment confirmation, receipt or invoice and handles transaction enquiries, including refund requests, under Stripe's and Link's terms.

The package sale is concluded when Stripe confirms the payment. Credits are added to the balance once that confirmation arrives; with delayed methods (such as bank transfer) this can take some time. You receive a purchase confirmation by email. An unpaid payment session expires with no effect.

7.Requests

  1. Submitting: you choose services, see the price in Credits and confirm the Request. Credits equal to the price are then reserved: they move from the available to the reserved balance. A Request can't be submitted without enough Credits.
  2. Acceptance: a Specialist reviews the Request and the ORI file. The contract to carry out the Request is concluded when the Request is accepted for work (status "In progress"). The Specialist may put the Request on hold and ask for more information (the reason is shown with the Request); the Credits stay reserved meanwhile.
  3. Rejection: the Provider may reject a Request when carrying it out is technically impossible or unreasonable (such as an unsupported ECU, or a damaged or previously modified ORI file), when the ORI file doesn't match the details given, or when the Request breaches these Terms or the law. All reserved Credits then return to the available balance.
  4. Delivery: the Specialist publishes the MOD file in the dashboard and marks which of the ordered services were delivered. We notify you by email when it's published.
  5. Settlement: when the Request is completed, Credits are charged only for delivered services. If all services were delivered, the Request price is charged (the bundle price, if it applied). If only some were delivered, each delivered service is charged at its own price at the time the Request was submitted, never more than the reserved amount, and the remaining Credits return to the balance. If none of the ordered services were delivered, all Credits return.
  6. Corrections: if a delivered file needs fixing, you can request a revision in your dashboard or contact us. Further MOD versions (V2, V3, …) within the same Request and its paid scope cost nothing extra; earlier versions remain available to download.
  7. Change of scope: additional services (such as EGR OFF on top of a Stage 1 file) are ordered with a new Request based on a version you choose, at the current prices. Services already delivered in the project are free in it.
  8. Cancellation: until the Request is completed you can ask for it to be cancelled by writing to ecuexpert2026@gmail.com. A cancelled Request releases all reserved Credits.

The MOD file is available for download in the Customer's dashboard for as long as the account exists. We recommend keeping your own copy of the ORI and MOD files.

8.Returning credits vs refunding money

These Terms distinguish two separate operations:

  1. Returning Credits to the balance: when a Request is rejected, cancelled or only partly delivered, Credits return to the available balance on the website and can be used for later Requests. This is not a refund of money.
  2. Refunding money to the original payment method: done through Stripe, in the cases set out in these Terms or by law (a Consumer's withdrawal, an upheld complaint, an erroneous payment), or under Stripe's/Link's rules with Managed Payments. The corresponding Credits are deducted from the balance.

We consider requests for a refund of money for unused Credits in other cases, including on account closure, individually: write to ecuexpert2026@gmail.com.

If Credits from a purchase were already used when the payment is refunded or a payment dispute is lost, the Provider doesn't automatically deduct them below zero or change settled Requests; the matter is resolved individually with the Customer.

Payment disputes (chargebacks): if you dispute a payment with your card issuer or bank, please contact us first at ecuexpert2026@gmail.com, which usually resolves the problem faster. While a dispute is open, the Credits stay on the balance. If the dispute is decided in your favour, the Credits from that purchase are deducted as with a refund.

9.Files, rights and the Customer's obligations

  • By uploading an ORI file, the Customer declares that they own the vehicle or act with the consent of its owner or another authorised person, and that they are entitled to hand over the file for modification.
  • The Customer is responsible for the ORI file being complete, original (unmodified) and taken from the vehicle whose details they provided, and for the accuracy of the vehicle, ECU and hardware details.
  • A MOD file is prepared for the specific vehicle the ORI file comes from. Writing it to another vehicle or ECU may cause malfunctions.
  • ECU software may be protected by the manufacturer's rights. The Provider doesn't transfer any rights to the manufacturer's software to the Customer; a MOD file may be used only in the vehicle it was prepared for.

10.Technical and legal limitations

  • The result of a modification depends on the engine, the vehicle's condition, its hardware and the software version. The Provider doesn't guarantee any particular power or torque gain.
  • Reading and writing an ECU carries technical risk (such as an interrupted write, an unsuitable tool or an unstable power supply). The Customer or their workshop does this at their own responsibility and should keep a copy of the ORI file.
  • Modifying the software may affect the vehicle manufacturer's warranty, insurance terms and the result of a roadworthiness test.
  • Services affecting emission control systems (such as EGR OFF and AdBlue OFF) change how those systems work. In Poland and other EU countries, a vehicle with such changes may not meet its type-approval requirements and may not be allowed on public roads. The Provider does not claim that such modifications are road-legal. The Customer is responsible for using the MOD file in line with the law where the vehicle is used.

11.Liability

The Provider is liable for performing the contract properly under the applicable law. These Terms don't exclude or limit the Provider's liability towards Consumers and sole traders with consumer rights where the law doesn't allow it, nor liability for damage caused intentionally.

The Provider is not liable for the consequences of circumstances it isn't responsible for, in particular damage resulting from the Customer uploading a file that doesn't match the details given, from the ECU being read or written incorrectly by the Customer or their workshop, or from the MOD file being used in another vehicle or unlawfully.

12.Conformity and complaints

The Provider delivers a MOD file in conformity with the contract, that is, prepared for the ORI file the Customer uploaded and covering the services marked as delivered. Towards Consumers and sole traders with consumer rights, the Provider is liable for lack of conformity of digital content and digital services under Chapter 5b of the Polish Consumer Rights Act.

You can submit a complaint to ecuexpert2026@gmail.com. Include your account email, the project or Request, a description of the problem and how you'd like it resolved. The Provider replies to complaints within 14 days of receiving them.

If there is a lack of conformity, a Consumer may demand that it be brought into conformity (such as a corrected MOD version, free of charge). If that is impossible, would require excessive costs, isn't done within a reasonable time, or the lack of conformity is significant, the Consumer may demand a price reduction or withdraw from the contract under the Consumer Rights Act. The refund is made in Credits to the balance or, if the Consumer requests it, in money to the original payment method, for the part corresponding to the service price.

13.Right of withdrawal

Consumers and sole traders with consumer rights may withdraw from a distance contract without giving a reason within 14 days of its conclusion. It is enough to send a statement before the deadline, for example to ecuexpert2026@gmail.com, also using the model form at the end of these Terms (this is optional).

  • Credit purchase: withdrawing within 14 days of the purchase means the amount paid is refunded to the original payment method within 14 days of receiving the statement, at no extra cost. The Credits from that purchase are deducted from the balance.
  • Modification Request: by submitting a Request, a Consumer expressly asks for the service to start before the withdrawal period ends and acknowledges that they lose the right of withdrawal once the service has been fully performed (the MOD file is published and the Request completed). This confirmation is recorded with each Request. Withdrawing before the Request is completed cancels it and returns all reserved Credits to the balance.

14.Dispute resolution

Consumers can use out-of-court complaint and redress procedures, for example by contacting a municipal or district consumer ombudsman or the regional Trade Inspection office in Poland. Information is available from the Polish competition and consumer protection authority, UOKiK. Using these procedures is voluntary.

15.Personal data

How personal data is processed is described in the Privacy Policy. Accepting these Terms is not consent to the processing of personal data.

16.Changes to these Terms

The Provider may change these Terms for important reasons, in particular a change in the law, in the scope or manner of providing the services, or in payment providers. We inform signed-in Customers at least 14 days before a change takes effect. A Customer who doesn't accept the changes may terminate the account contract before that date.

Requests submitted and purchases made before a change are settled under the version of the Terms in force when they were made. The website asks you to accept a new version with your next purchase or Request and keeps the history of acceptances of every version.

17.Governing law and final provisions

These Terms are governed by Polish law. This choice doesn't deprive a Consumer of the protection given by the mandatory provisions of the law of the country where they habitually live. Disputes are resolved by the court competent under the general rules.

The choice of law doesn't deprive a Consumer of the protection given by the mandatory provisions of the country where they have their habitual residence. Disputes with Consumers are decided by the court competent under the general rules.
